International Summer School on “The Regulation of Robotics in Europe: Ethical, Legal and Economic Implications”.

We are pleased to announce the first edition of the International Summer School on “The Regulation of Robotics in Europe: Ethical, Legal and Economic Implications”.

This unique initiative, funded by the European Commission through the Jean Monnet Program, stems from the successful experience of the RoboLaw (www.robolaw.eu) project and its subsequent developments.

The aim of the summer school is to provide students with a broad understanding of the many relevant implications of the regulation of robotics in Europe by

(i)                  Analyzing applicable European regulation and the standards enterprises need to conform to;

(ii)                Discussing the relevant ethical and societal issues existing and foreseeable;

(iii)               Analyzing the economic and management challenges robotic enterprises face

The teaching body is extremely diversified, including Lawyers, Engineers, Philosophers, Business and Management Experts, many of which directly participated in the RoboLaw project, to provide the most interdisciplinary perspective.

The coordinator of the Summer School is Dr. Bertolini, Assistant Professor of Private Law at Scuola Superiore Sant’Anna, and one of the leading experts in the regulation of robotics in Europe. Dr. Bertolini advised the European Parliament and Commission on multiple occasions in particular on issues regarding the regulation of robotics, liability and risk management and product standardization. His research is widely covered by national and international press, including The Economist, The Times, The Guardian, BBC Radio, Wired, Motherboard, Robotic Business Review, Corriere della Sera, Sole 24 Ore, La Stampa, Quotidiano Nazionale.

Europa Working Paper No 2016/04

Abstract:
We argue that EU law and the ethos of European integration, premised on inclusiveness and the taming of the state requires the Union to remain neutral in the context of the permutations of statehood at the national level leading to the emergence of new state entities in Europe. We show that the matter of permutations of statehood is not new or exceptional, unlike what is sometimes claimed, and demonstrate that the EU is not to blame for facilitating the viability of newly-emerging states in Europe, since this is one of the natural bi-products of the very nature of the Union. In this context intervening in national constitutional secession politics and making threats to prevent the newly-emerging states from joining the EU would not only be an ultra vires action for the EU to take. It would also be both counter-productive and deprived of any purpose, which leads us to conclude that EU law should be deployed as inventively as is necessary to ensure continued membership of the EU of the entities seceding from the current Member States.

Erasmus+ Joint Master Degree on “Parliamentary procedure and legislative drafing” (EUPADRA) - New deadline for scholarsips' applications: 21st March 2016‏

Erasmus+ Joint Master Degree on “Parliamentary procedure and legislative drafing” (EUPADRA) - New deadline for scholarsips' applications: 21st March 2016‏

On Behalf of Prof. Nicola Lupo

"Dear Colleagues,

I hope this message finds you well and apologies for the collective message.
I am writing you because, as you probably remember, you and your institution kindly accepted to support the EUPADRA Master Degree.
The three partner institutions have just decided to postpone the deadline for EUPADRA scholarships’ application from the 15th March to 21st March 2016.
The applications to date are less numerous than we were expecting: it is the first year of the program and this is understandable.
Therefore, it would be excellent if you could inform graduate students and practitionners that could be interested in apply: if they have a good cv, the chances to obtain one of the rich scholarships granted by EACEA are rather high!
Please find attached a message, in case you want to circulate it (of course, amend it as you wish).
For further info, you or potential candidates could consult the website www.eupadra.eu (on which you find the most of the syllabi of the courses offered) and write to eupadra@luiss.it.
Kind regards,

Nicola Lupo
EUPADRA Director

Max Weber Lecture: Same-Sex Marriage and Backlash: Constitutionalism through the Lens of Consensus and Conflict‏

http://www.eui.eu/SeminarsAndEvents/Events/2016/March/MaxWeberLecturewithRevaSiegelYaleUniversity.aspx

"In the decades before the United States Supreme Court recognized the right of same-sex couples to marry in Obergefell v. Hodges, Americans disdained, denounced, and debated same-sex marriage. When state courts recognized the right of same-sex couples to marry, opponents passed laws and state constitutional amendments that defined marriage as the union of a man and a woman. This fierce conflict provoked argument about the capacity of courts to defend minority rights.
Critics argued that judicial judgments shutting down politics were counterproductive and provoked a backlash that exacerbated political polarization. Conversation about the backlash ranged widely from academics and advocates to judges. These "realist" accounts of judicial review depicted courts as majoritarian institutions whose authority is tied to public consensus.
In this lecture, I will argue that the backlash narrative and the consensus model of constitutionalism on which it rests simultaneously underestimates and overestimates the power of judicial review. The Court's decision in Obergefell was possible not simply because public opinion changed, but also because the struggle over the courts helped change public opinion and forge new constitutional understandings. Even so, Obergefell has not ended debate over marriage but instead has channeled it into new forms. Constitutions do not merely reflect consensus; they also structure conflict. I employ concepts of constitutional culture to explore how constitutions can give contested beliefs legal form and structure conflict in ways that help sustain community in disagreement
